But here’s the truth many shops overlook:

Embroidering a corporate logo is not just a production job — it’s a legal responsibility.

Let’s break down what trademarks mean, how they apply to embroidery, and how to protect your shop.


What Is a Trademark?

A trademark is a legally protected name, logo, symbol, or design that identifies a brand.

When you see:

  • ® (Registered Trademark)

  • ™ (Trademark)

  • SM (Service Mark)

That means the logo or brand identity is protected under intellectual property law.

You cannot legally reproduce or sell merchandise with that logo unless you have proper authorization.

This includes:

  • Corporate logos

  • College and university logos

  • Professional sports team logos

  • Mascots and slogans

  • Brand emblems

Even if a customer brings you the file.


“But the Customer Gave Me the Logo…”

Just because a customer provides:

  • A copy of a logo from Google

Does NOT mean you have permission to produce and sell it.

Permission must come from the logo owner — not the customer — unless the customer represents that company and provides written authorization.

Always run a test sew-out before production.

4️⃣ Clarify Use Rights

Make sure the customer understands:

  • You are producing for approved use only

  • You are not granting resale rights beyond their authorization


Special Warning: Colleges & Professional Sports Teams

College logos and professional sports logos are aggressively protected.

You cannot legally:

  • Combine mascot logos with custom text

  • Add team names to stock mascot artwork

  • Create merchandise using their branding

Without written authorization from the institution.

Even small local runs can trigger enforcement.
